Rule 16
Provisions related to cases under sub-section (2) of Article 137 of the Constitution
(1) Petitions for cases under clause (a) of sub-section (2) of Article 137 of the Constitution can be made by any Nepali citizen who is an authorized officer of the concerned union, state or local level or who is interested. .
(2) In the application given according to sub-rule (1), the following facts should be disclosed:-
(a) Name, Surname, Nationality,
of the applicant and the respondent (b) Matters relating to the Jurisdiction of the Bench. (c) Constitutional and legal arrangements in the constitution and federal laws regarding the exercise of powers of the union, state and local levels,
(d) What, how and what kind of dispute has arisen between the union, state and local levels about jurisdiction,
(e) Remedies sought.
(3) Any Nepalese citizen who is concerned or concerned can submit a petition under Clause (b) of Clause (2) of Article 137 of the Constitution. (4) In the application form given according to sub-rule (3), the following things should be disclosed:-
(a) Full name, surname, nationality of the applicant and the respondent (b) Matters relating to the Jurisdiction of the Bench,
(c) The reason why the election of a member of the Federal Parliament or the Provincial Assembly should be invalidated,
(d) The matter of how a member of the Federal Parliament or the State Assembly is disqualified (e) Related Legal Provisions,
(f) Other essential subjects.
(5) By sub-rules (1) and (3) a fee of five thousand rupees will be charged when registering the application for registration.
(6) In relation to the controversy raised in the application as per sub-rules (1) and (3), a written answer shall be submitted in point-by-point rebuttal or admission.
(7) Submission of a written answer according to sub-rule (6) will be subject to a fee in accordance with the prevailing law.
(8) In the dispute under clause (a) of sub-section (2) of Article 137 of the Constitution mentioned in the application under sub-rule (1), if the relevant party applies to withdraw or settle the case and if the bench finds it necessary and appropriate to withdraw or settle such case, such case He can grant permission to withdraw or arrange settlement.
